Secure File Transfer for Legal Firms

Law firms of all sizes are challenged with transferring volumes of files and documents of increasingly large size to external parties. Adding to this challenge is the pressure to ensure client confidentiality. Regulations regarding the protection of intellectual property, personal data, financial transactions and executive communications must be adopted, implemented and integral to collaborative processes. To complicate matters further, legal firms and legal departments must track information to verify and prove that breaches do not occur, and to classify the extent of exposure if they happen.

The Law Society's guidelines on email communications suggest:

Firms should not include confidential information in non-encrypted e-mail without the informed consent of clients, whether corporate or individual.

Firms are recommended to adopt systems that provide the facility to automatically encrypt all outgoing email and for receiving encrypted email.

Firms should ensure that all relevant devices including laptops, PDAs and home computers used for business-related work are brought within the scope of their IT and e-mail security policies

Similarly, the Solicitors Regulation Authority states in Rule 4 (44 n) of the Solitors Code of Conduct relating to Safeguards for information barriers:

that the firm implements a system for the ... distribution of e-mail which will ensure that confidential information is not disclosed to anyone outside the restricted group.

Any business that loses sensitive data can suffer both financial implications and damage to their reputation.  With the increasing number of data breaches and the Information Commissioners Office (ICO) under pressure from the European Commission (EC) to implement data privacy legislation, now is a great time to make sure your firm or department won't be caught out.
